In The Eyes Of The Law, Elder Simon Achuba Remains The Deputy Governor Of Kogi State

Following the illegal imleachment of the deputy Governor of Kogi State, in person of Elder Simon Achuba, alot of Legal Luminaries are talking tough!

In this particular write up, OurWorldGist ( www.ourworldgist.com ) brings you the reaction of that of Realwan Okpanachi, Esq.

Let us read him:

” By the provisions of Section 188(8), of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), the Report of the Panel setup by the Chief Judge of Kogi State pursuant to the power conferred on him in Section 188(5) stating unequivocally that, “the Deputy Governor was not guilty of all the allegations contained in the Notice of Impeachment” is final and brings to an end the Impeachment process.

In order words, the Report of not guilty is the final bus-stop for the impeachment process.

For avoidance of any doubt, Section 188(8) provide thus: “Where the Panel reports to the State House of Assembly that all the allegations have not been proved, no further proceedings shall be taken in respect of the matter. ”

Flowing from the above, it is obvious that, the action of the State House of Assembly in purporting to impeach the State Deputy Governor even when he was cleared of all the allegations contained in the Notice of Impeachment is nothing but a gross and violent violation of the provisions of the Constitution of the Federal Republic of Nigeria, 1999 (as amended).

Consequently, any appointment made or to be made in replacement of Elder Simon Achuba as the Deputy Governor of Kogi State and to occupy an office that is not vacant is/will be null and void.

The men who are expected not only to behave as but be seen as Honourable men have become very Dishonest and Dishonourable men.

This is because, you cannot brazenly rape the Constitution that created the office you enjoy and still be seen and/or regarded as Honourable.

If I may ask, where is the conscience of the Lawyer(s) among these Dishonourable men?

This particular incident has again shown that, there is no House of Assembly in Kogi State.

What we have in the State is an aberration called ‘House of Yahaya Bello’.

One thing that must be noted very seriously, is the fact that, there is time for everything.

A time will come when the same Dishonourable men will be victims of the lawlessness they are entrenching in Kogi State.

Certainly, they will not remain in the House of Assembly forever.

The Deputy Governor, Elder Simon Achuba that is at the receiving end today, was once a member of the State Assembly and part of those that almost impeached the Best Governor in the history of Kogi State if not Nigeria, Late Prince Abubakar Audu.

I expected the Dishonourable members of the House to learn from the mistakes those that served in the House of Assembly before them.

If they have another chance, I know, they will stand by the people and the Constitution having become a shadow of their old selves.

Particularly that, they have now realised that, the only thing that last forever is not money but character/integrity.

The crumbs they are getting from Yahaya Bello today which is their motivation for the unconstitutional and wicked actions, will surely not last them long, I assure you.

To those who are celebrating the death of Democracy and Constitutionalism in Kogi State, please, watch your back and learn how to subject your interest to that of the people and the society.
